General Approach – Adaptability with an Open Mind
As a dedicated Mediator, fully committed to the process, I long ago learned to adapt to the facts before me. Each and every matter is as unique as the participants. I deeply respect and appreciate the nuances that each party brings to our mediation.
As societal events required a modified approach, I was one of the first mediators in Southern CA to embrace, develop and tailor my approach to virtual mediations. While the process has changed, the settlement rate of cases remains high. I am always pleased to provide a brief review of technology, “road testing” the technical process with a practice session with any and all participants. If you have a smartphone or computer with a microphone, speaker and camera, we can mediate. I have successfully mediated multiple cases with international participants located half way around the globe.
Pre-Mediation Conference
It is my general practice to share separate, brief discussions with counsel and/or self-represented parties prior to mediation to review the process, general dispute, unique factors, party concerns, identification of key participants and documentation and demands/requested outcome.
Mediation Session(s)
As a neutral, third party, my role is to assist the parties to review their needs, issues and requests, seeking common ground and ultimately resolution. Unlike through an Arbitration, as the Mediator, I cannot issue any edicts, or rulings. The parties are the decision makers; I pave the way forward so they may arrive at resolution.
Resolution
If the parties resolve their issue, they will execute a formal, written document confirming the terms of settlement.
Alternative, Ongoing Process
In the unlikely event a matter does not resolve, I remain committed to the process, following-up at the parties’ request, with continued assistance. There are times when mediation may hone the issues, thereby providing additional homework for the parties to undertake before they may adequately consider settlement.
